本利用規約（以下「本規約」）は、**「わたしの体調」**（以下「本アプリ」）の利用条件を定めるものです。ユーザーは、本規約に同意のうえ、本アプリを利用するものとします。
1. 適用
本規約は、本アプリの利用に関して、ユーザーと提供者との間に適用されます。なお、本アプリに関するプライバシーの取り扱いについては、別途定めるプライバシーポリシーが適用されます。
2. サービス内容
本アプリは、ユーザーが日々の体調、疲労感、不調、顔まわりの変化、メモ等を記録し、HealthKit データや気象情報等とあわせて振り返ることを支援するアプリです。
本アプリは、体調の記録、可視化、振り返り、傾向把握を目的とするものであり、医療診断、治療、予防、緊急対応を目的とするものではありません。
3. 利用条件
ユーザーは、自己の責任において本アプリを利用するものとします。未成年者が利用する場合は、必要に応じて保護者その他法定代理人の同意を得て利用してください。
4. アカウント等
本アプリは、独自の会員登録アカウントを必須とする設計ではありません。ただし、有料機能の利用、HealthKit の利用許可、通知の利用許可等については、Apple の仕組みや端末設定に従うものとします。
ユーザーは、本アプリを利用するために必要な端末、OS、通信環境等を自己の費用と責任で用意するものとします。
5. 有料機能およびサブスクリプション
本アプリには、有料機能またはサブスクリプションが含まれる場合があります。料金、課金時期、更新、解約、返金等は、Apple の App Store および StoreKit の仕組みに従います。
ユーザーは、有料機能の購入に関して Apple が定める条件にも従うものとします。
6. ユーザーデータ
ユーザーが本アプリに入力・記録したデータは、主にユーザーの端末内に保存されます。ユーザーは、バックアップ機能や共有機能を利用する場合、書き出したデータの管理責任を負うものとします。
本アプリは、ユーザーの記録内容について、ユーザー自身の利用のために保存・表示・整理・分析することがあります。
7. 禁止事項
ユーザーは、本アプリの利用にあたり、以下の行為を行ってはなりません。
- 法令または公序良俗に反する行為
- 本アプリの運営を妨害する行為
- 本アプリの不具合、制限、課金処理等を不正に回避・改変しようとする行為
- 本アプリのプログラム、表示、データ等を無断で複製、改変、再配布する行為
- 第三者の権利、利益、プライバシーを侵害する行為
- その他、提供者が不適切と判断する行為
8. 知的財産権
本アプリおよび本アプリに含まれるプログラム、デザイン、文章、画像、ロゴ、表示その他一切の権利は、提供者または正当な権利者に帰属します。
9. 保証の否認
提供者は、本アプリについて、完全性、正確性、有用性、継続性、特定目的適合性、エラーや中断の不存在等を保証するものではありません。
特に、本アプリに表示される体調傾向、インサイト、比較結果、通知内容等は参考情報であり、医療的判断を代替するものではありません。
10. 責任の制限
提供者は、本アプリの利用または利用不能によりユーザーに生じた損害について、提供者に故意または重過失がある場合を除き、責任を負わないものとします。
また、提供者が責任を負う場合であっても、その責任は、ユーザーが当該時点で本アプリに関して実際に支払った対価の総額を上限とします。ただし、法令によりこの制限が認められない場合はこの限りではありません。
11. サービスの変更・停止・終了
提供者は、ユーザーへの事前通知または通知なしに、本アプリの全部または一部の内容を変更、停止、または終了することがあります。
これによりユーザーに生じた損害について、提供者は責任を負いません。ただし、法令上必要な場合を除きます。
12. 本規約の変更
提供者は、必要と判断した場合、本規約を変更できるものとします。重要な変更がある場合は、アプリ内または配布ページ等で周知することがあります。
13. 準拠法・管轄
本規約は、日本法を準拠法とします。本アプリに関して紛争が生じた場合は、提供者の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service (“Terms”) set forth the conditions for using My Condition (the “App”). By using the App, you agree to these Terms.
1. Scope
These Terms apply to the relationship between the user and the provider with respect to use of the App. The App’s separate Privacy Policy also applies to the handling of personal information and related data.
2. Service Description
The App is intended to help users record daily condition, fatigue, discomfort, face-area changes, notes, and related information, and to review those records together with HealthKit data and weather-related information.
The App is intended for recording, reviewing, visualizing, and understanding trends. It is not intended for medical diagnosis, treatment, prevention, or emergency response.
3. Eligibility and Conditions
You use the App at your own responsibility. If you are a minor and parental or guardian consent is required under applicable law, you must obtain such consent before using the App.
4. Accounts and Device Environment
The App does not require its own standalone user account system for basic use. However, paid features, HealthKit permissions, and notification permissions may depend on Apple systems and your device settings.
You are responsible for preparing and maintaining the device, OS, network environment, and any other requirements necessary to use the App.
5. Paid Features and Subscriptions
The App may include paid features or subscriptions. Pricing, billing timing, renewal, cancellation, refunds, and related matters are governed by Apple’s App Store and StoreKit systems.
You also agree to comply with Apple’s applicable terms for in-app purchases and subscriptions.
6. User Data
Data you enter into the App is primarily stored on your device. If you use the backup or sharing features, you are responsible for the management of exported or shared data.
The App may store, display, organize, and analyze your records for your own use of the App’s features.
7. Prohibited Conduct
You must not engage in any of the following when using the App:
- Acts that violate laws, regulations, or public order and morals
- Acts that interfere with the operation of the App
- Attempts to improperly bypass, alter, or exploit bugs, restrictions, or billing mechanisms of the App
- Unauthorized copying, modification, redistribution, or misuse of the App’s software, content, or data
- Acts that infringe the rights, interests, or privacy of others
- Any other conduct the provider reasonably considers inappropriate
8. Intellectual Property
All rights related to the App and all software, designs, text, images, logos, displays, and other content included in the App belong to the provider or the legitimate rights holders.
9. Disclaimer of Warranties
The provider does not guarantee the completeness, accuracy, usefulness, continuity, fitness for a particular purpose, or error-free operation of the App.
In particular, condition trends, insights, comparison results, and notification content shown by the App are for reference only and do not replace medical judgment.
10. Limitation of Liability
To the maximum extent permitted by law, the provider is not liable for damages arising from your use of, or inability to use, the App, except in cases of intentional misconduct or gross negligence by the provider.
If the provider is held liable, that liability will be limited to the total amount actually paid by the user for the App at the relevant time, unless such limitation is not permitted under applicable law.
11. Changes, Suspension, or Termination of Service
The provider may change, suspend, or discontinue all or part of the App, with or without prior notice to users.
The provider is not liable for damages resulting from such changes, suspension, or termination, except where required by law.
12. Changes to These Terms
The provider may revise these Terms when deemed necessary. Material changes may be announced within the App or on distribution or support pages where appropriate.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the provider’s location as the court of first instance.
